Politics, law and human rights ‘fanatics’: AG Walter Woon

DO NOT confuse politics with the law, Singapore’s new Attorney-General cautioned, and “be careful” of those who use human rights “to advance their own political agendas”.

Professor Walter Woon made the point at his first public appearance as Attorney-General yesterday, as the Law Society launched a high-powered committee seeking to “encourage the promotion and discussion of public and international law issues”.


While he described the new committee as a “commendable initiative” — since everyone “has a vested interest in good governance” — Prof Woon cautioned Singaporeans against taking the Government to court simply because they do not agree with its decisions.

“We have to be careful when we talk about public law, and not to confuse law with politics. There are many people who think if a decision is made and they don’t like it, then this is something the law can correct. There is a line between a political decision and a legal decision,” he said.

The new committee’s maiden project is to study the relevance of the United Nations’ Universal Declaration of Human Rights in Singapore law.

Prof Woon weighed in on the issue with several strong words. Noting that human rights is “now a religion among some people”, he said: “You have, like in some religions, the fanatics. And it’s all hypocrisy and fanaticism (for these people) to set the views, as the leading spokesmen, of what is acceptable and what’s not.”

Prof Woon stressed, it is a “misconception that Singapore officialdom is against human rights”. He said: “What we are against is the assumption of some people that when they define what’s human rights, that decision is the decision of the rest of humanity.”

Reiterating that civil liberties must be seen in “the context of our society”, the Attorney-General observed how some places allow insults to be hurled against religions. “Is this what we want? Even if we don’t pay the price, our children will pay the price.”

Prof Woon also voiced his disapproval of advocates using human rights to pursue their own causes. For instance, while the issue of same-sex marriage has been framed as an issue of human rights, he questioned: “Is this a question of human rights?”

He also cited the example of how a lawyer accused the court of breaching human rights, after it ruled against his client in a suit she had taken out against the Government when her son fell down in school.

“The lawyer wrote in to say it was a breach of human rights — the right to survival — that we should enforce the cost against the client,” said Prof Woon.

:Legal academic and Nominated MP Thio Li-Ann, who gave a talk yesterday on human rights, agreed that politicising the issue undermines civil liberties as certain rights are promoted at the expense of others.

Still, she noted, the Singapore Government does not speak “the language of human rights”. When it abolished the quota for female undergraduates in medical school, no mention of the word “right” was made in Parliament; yet in its report to the UN, the Government cited the move as a step forward for women’s rights.

Several reasons could be behind this, Prof Thio said, including how Singapore’s communitarian society frowns upon “radical individualism”. But she disagreed with the perception that human rights promotes individualism, noting that the wording of the UN declaration places a greater emphasis on “collectivism”.

She also noted that the Government “legitimates itself not so much by consigning rights but by performance”. While she felt it was “good thing” in terms of upkeeping the living standards of the citizens, she said: “The problem is, can we indefinitely sustain the high economic growth rate? What happens when the ball drops?”

Singapore. Judge Belinda Ang's Kangaroo Court
Ladies and Gentlemen,

This is Gopalan Nair in Singapore today, May 29, 2008. I have been in Singapore since May 25, 2008, and staying now at Broadway Hotel, Room 708, 195 Serangoon Road, Singapore 218067.

I am deliberately stating my identity and my present exact location for a definite purpose. On day 2 of the trial in Singapore, day before yesterday, in the Lee Kuan Yew and son verses Dr. Chee Soon Juan case, Lee senior had said in answer to a question by Dr. Chee, that if he, Lee Kuan Yew, knew the identity of bloggers in cyberspace who defamed him (defamation being used of course in the Singaporean sense), he will sue and bankrupt them.

He had earlier sidestepped the question by saying, that he had difficulty suing critics of his in the Internet because their identities were not usually known. When pressed, he categorically and deliberately stated that he will sue if they made known their identities.

Well, what you are going to read should be without question defamatory of Mr. Lee and his son, that is in the warped and hare brained Alice in Wonderland meaning of the word "defamation". It will be interesting to see if this Singapore strongman, Lee Kuan Yew and son, who strut around the small island of Singapore bullying everyone who so much as criticized, will sue me now for calling him nothing more than a small time street bully; since now, we have myself Gopalan Nair who has the temerity to identify himself and state his presence with full address in Singapore.

Mr. Lee Kuan Yew, see here. I am now within the jurisdiction of your courts; I repeat, "the jurisdiction of your courts" because literally they are your courts, willing to commit any crime or injustice you will demand of them.

During the last 3 days of the court hearing, up till yesterday, in the High Court, before your stooge of a judge, Belinda Ang in Court 4, you and your Prime Minister son conducted yourselves as expected, no better than cowards hiding behind the coat tails of your equally cowardly counsel doubling up as a PAP politician in court; who managed with the full co-operation of the said judge to ensure that you came to court merely for form, refusing to answer almost all questions that went directly to your integrity or rather the lack of it.

After the end of the 3 days in court, it left no doubt in my mind that you and your son are indeed what international human rights organizations say you are, nothing more than tin pot tyrants who remain in power by abusing the courts to eliminate your political opponents. You are clearly corrupt, as is your government, because paying yourself $3.7 million is corruption pure and simple and in the end you have lost all credibility and moral authority to govern Singapore.

The following transpired during the last 3 days in court. The judge Belinda Ang was throughout prostituting herself during the entire proceedings, by being nothing more than an employee of Mr. Lee Kuan Yew and his son and carrying out their orders. There was murder, the rule of law being the repeated victim.

The issue in the said court was the determination of the quantum of damages payable by the innocent victim, Dr. Chee Soon Juan who had earlier been found liable by this judge for defamation of character of Mr. Lee and son, where the law was once again abused through the contrivance of a process known as summary proceedings, thereby disallowing Dr. Chee to produce any witnesses or to cross-examine those of Mr. Lee because there were none.

The said 3 day of hearing before the court was nothing more than a mockery of justice; a charade, a make believe that appeared right out of the pages of Alice in Wonderland with Belinda Ang playing the role of the Queen of Hearts before the trial of the Mouse who stole the Tarts very well indeed. It almost appeared that she was going to dispense with all testimony and come straight to the verdict of guilty so as not to waste her valuable time!

It would be fair to say, in fact an understatement, that in effect she disallowed Dr. Chee any effective cross examination of either the father Lee Kuan Yew or the son, as Mr. Singh, their counsel was almost having a workout like in a gym; standing up to object, and sitting down after almost each and every question that Dr. Chee put to his father and son clients. In fact Singh was popping up and down almost without let up during the several hours of the hearing so much so, that someone suggested to me that it would have been a good idea if he remained standing throughout the case to facilitate his expected objections at each and every question of Dr. Chee.

If Dr. Chee did manage to ask even one question, it was because he went ahead and asked it despite the objection of both Mr. Singh and the judge because if he did not, he would not have been able to ask any questions at all!

Dr. Chee has asked Lee's son how much he was being paid, that is $3.7 million, 6 times what George Bush is paid! Question disallowed and the son shamefully just sits there, protected by his counsel Mr. Singh and the kangaroo judge.

Chee asks whether it is just for him to corruptly steal this amount of taxpayer's money while the poor in the 1 room flats starve without any financial assistance! Question disallowed and the son shamefully just sits there, protected by his counsel Mr. Singh and the kangaroo judge.

Chee asks why the GIC and HDB function under a shroud of secrecy without any transparency, when the moneys in them is taxpayers money? Question disallowed and the son shamefully just sits there, protected by his counsel Mr. Singh and the kangaroo judge.

Chee asks whether he knew that those who read the Internet overwhelmingly hated him as a tyrant and a bully and the only ones singing praises in his name are the Singapore state owned and controlled media? Question disallowed and the son shamefully just sits there, protected by his counsel Mr. Singh and the kangaroo judge.

Chee asks whether the international community looks at him no better than a despot and a father's son? Question disallowed and the son shamefully just sits there, protected by his counsel Mr. Singh and the kangaroo judge.

Chee had asked this Lee Kuan Yew's son why he said in the 2006 elections that " if there were more opposition candidates at elections, he will have to "fix" them and bribe his voters to win elections"? Question disallowed and the son shamefully just sits there, protected by his counsel Mr. Singh and the kangaroo judge.

There were many more questions put to him just as the above questions, all very relevant, which, had they been answered, would have shown that he had no integrity or reputation whatsoever, and since integrity and reputation are the issues in deciding quantum of damages, Lee Kuan Yew's son should have been awarded no damages at all; that is provided we have an independent judiciary, which we have not.

Any honest spectator in the court's gallery would have come away with one opinion alone, that is, this man is Prime Minister only because he happens to be the son of his father. If he really wanted to show that he was in fact in control, he could have easily told his lawyer to stop being the Jack in the Box and stop popping up and down with his objections and let him handle the questions. At each question, he was looking meekly at his counsel to see whether he has to answer it. If I could put it in a simple way, he was nothing more than a helpless boy.

The following refer to Lee Kuan Yew's testimony or rather the lack of it.

Chee asked him whether he came to power through unfair means in 1959, as shown by declassified British Colonial Office documents in London? Question disallowed and the father shamefully just sits there, protected by his counsel Mr. Singh and the kangaroo judge.

Chee asks about his throwing Lim Chin Siong, his political compatriot, in jail under the ISA in solitary confinement for several years in the 1960s and whether this was a sign of a man with a reputation and integrity? Chee asks about the Operation Cold Store in the 1960s where he jails political opponents because he fears he might be overthrown? Question disallowed and the father shamefully just sits there, protected by his counsel Mr. Singh and the kangaroo judge.

Chee asks about Chia Thye Poh, Zaid Zakaharia and Lim Hock Siew, his political opponents whom he imprisons without cause for many many years? Question disallowed and the father shamefully just sits there, protected by his counsel Mr. Singh and the kangaroo judge.

Chee asks whether the only people who have a good opinion of him are his state owned and controlled Singapore press, whereas everyone else in Singapore as well as the entire list of respectable foreign organizations and countries including the entire European Union consider him as a thug and small time street bully? Question disallowed and the father shamefully just sits there, protected by his counsel Mr. Singh and the kangaroo judge.

Other than the dubious Transparency International Kula Lumpur Chapter (not to be confused with Transparency International of Berlin Germany) he was asked whether anyone else considered him in high regard other than the local press which he controls? His answer was that PERC and a Swiss organization, both of whom cater for businessmen thought highly of him. But when asked whether highly respected Amnesty International, Human Rights Watch, Lawyers Without Borders, Reporters without Borders, ILRW and several other international bodies considered him a crook; he had nothing to say, because as usual the Jack Rabbit Davinder Singh stood up once again to object and the judge obediently sustained the objection.

Then Lee Kuan Yew went on to insult Dr. Chee with impunity, that he is a liar, a cheat a charlatan, a criminal and what not. Of course the judge permitted these insults, since after all Lee Kuan Yew and his son owned the courts and the judge as well.

These court proceeding were nothing more than a sham, a charade and a mockery of justice. It was very clear that both father and son had no integrity or credibility whatsoever. They were ruling Singapore through fear and those who are able to leave the country leave it in droves, only to be replaced by Mandarin speaking immigrants from the Peoples Republic of China who speak no English at all.

If there was one result of these proceedings it was this. Dr. Chee' impeccable reputation was vindicated. He came out of these proceedings truly as the statesman that he is, and he demolished these two petty thugs Lee and his son, perhaps not in this Singapore kangaroo court, but truly in the court of truth and conscience.

And in fact despite the objection of Mr. Singh and Belinda Ang, Dr. Chee Soon Juan did manage to say to both father and son, that regardless of what the court decides, in the court of natural justice, in the court of truth and in the court of moral conscience, they had that day lost all moral authority to govern Singapore.

I believe, not only me, but every single person who walked away from that courthouse yesterday came away with that same judgment.

As the Lees know, I am a lawyer practicing in Fremont California and a member of the California Bar. My question to Lee Kuan Yew and his son is this. Are you going to stand by your threat and sue me for defamation as well? I am presently physically within your jurisdiction and the jurisdiction of your kangaroo courts. Are you going to going to send your process server to me with your writ of summons? Or are you, as expected, all talk and no action, when you meet those not afraid of you, just as how a petty street thug would behave?

for charity, JUST DO IT!

in buddhism, we always preach and practise about the great compassion.

why some are richer than other...some are poorer...there is a reason. buddhists base that on karma and retribulation from the past lives.

buddhism is such a wonderful and beautiful philosophy. it encourages people to be mindful of their less unfortunate brothers and sisters. it smiles on compassionate people who are rich to help the poor cos the buddha-nature of a person has been brought forth.

by doing charity to others, we plant a buddha seed of compassion within ourselves. according to buddhism, this seed will be the good fortune to carry us for the next life. hence buddhism encourages kindness, generosity and compassion.

let's put whatever next life is going to offer us one side first when we do kind deeds.

have u tried do a kind deed? a very simple one? how do u feel after u have done that kind deed?

well, for me, i felt immense happiness within myself. the opportunity to help another beings is not always there for u to delegate ur compassion. but if the conditions were put there for u...u just do the good deed.

however, if instead of doing a good deed, one does the reverse, what is going to happen? nothing actually. at least not now but he has unwittingly sown a bad seed in his karma.

this is what i want everyone to know...that our paps are not doing enough to sow those good compassionate seeds. they neglected the poor and needies. the allocation of funds from our humongous bragged about reserves has never been fairly returned to peasants. the poor and needies benefitted minimal and that comes with a barrage of mouthful of satirical comments like "where u want ur meals to be - hawker centres or restaurants?".

it isn't subsidies that peasants are asking for. but at the foot of the ivory tower where all the 82 paps dwell, there are indeed many peasants who are suffering.

if the gabramen keeps saying subsidies are bad. we should be independent, then where is their duties to show compassion. if they do not show such kindness, the peasants would just learn from them and be unkind and self-centred. the result is we have a very cold and hardened society which only cares for themselves.

hence, the great divide is widening and ever growing bigger.

this is my humble sharing to all who detest charity. you can't be wrong to hate charity here cos there were too many failures one after another in sinkapoor.

but charity stems from our heart...from our compassion to make another fellow being happy. by making our less fortunate happy, we in turn make ourselves happy.

when the poor are not happy, sooner or later they would fight for their kind of 'happiness'. those kind of 'happiness' and fulfilments of their needs could be in the form of crimes such as robbing the rich.

the reason that min yi monk came up with "to help more needies" and blah-blah.... those were quite hypocritical. there was the annual charity program for donations. it would have suffice the needs of RENCI charity.

the monk failed himself and the public's trust in him. but the bigger sin is he might have failed followers who might now be skeptical about BUDDHISM.

so here to remind everyone:

TRUST THE RELIGION AND HAVE FAITH IN IT...but not the monks who execute it. at the end of the day, it's all about you and your dormant BUDDHA only and nobody else.

Do you really need a leader like Chia Ti Lik leading Singapore? A womaniser leader? I was once his regular chatting mate in MSN and he did admit that he had an affair with a client age 30+ in his office. I guessed it was JaslynGo.
Yes, it might be his rights as a human being but we are given a brain to think as a human being. Sad to say he never use his brain wisely to think.
He admit to me, he love Jaslyn in our recent chat but why he need to do it secretly and hurts his wife (Michelle Yan) feelings and also Jaslyn’s husband at the 1st place?
Why all the secrecy relationship?
If both of them no longer love their partners, why not be frank to them?

I don’t understand what is so explicit about this post.

To me, the deeds of the LEE regime are so graphic that the lurid references mentioned in your post pale in comparison.

The group of 13 bloggers including myself are campaigning for political content to be totally free, and that means abolishing certain sections of the films act and PEA.

In Singapore politics, some of the political happenings are more lurid than the sex acts mentioned.

If we can campaign for political content to be liberalized, what is this to us?

Defamation suits against truth speakers. Unconstitutional arrests of people exercising their rights. Police warnings and investigations on innocent folk who are merely speaking up for themselves. Aren’t these cowardly acts more vulgar than the sex actions mentioned in your post?

If you say PG16 on your post, I say PG13 on the PAP itself, for they are more vulgar than any prostitute I have cum across, and believe me I have been there and done that.

90 days and still no news

the great mas selamat's escape has reached more than 90 days. there is no news. the paper prints today about the great baptism of termination, discipline and demotion.

does that appease the emotion of the nation for letting loose a dangerous #1 terrorist under the watchful eye in a detention camp?

strangely, the highly or overly bragged about police here couldn't located mas after a 3 months period. talking about efficiency or efficacy and what about a lst class national security? it's such a slap in our own face!

3 perceptions arise from this:

1. mas has escaped and left singapore and back in one of the indonesian remote islands

2. mas was already dead. the escape news release was a diversion to the actual fact that he could be dead in the detention.

3. the more unlikely scenario. his escape into our forest was met with disastrous fatality....liked being pounced upon by a big python and was already snake food or snake poo by now. hahahaha....it could have happened what!!

in a tight security detention camp, he could have escaped, then why couldn't be be swallowed whole by a helpful hungry python in the forest? if #3 deduction is true, we are really blessed with monstrous snakes bigger and more efficient than the paps! hahaha...;9)

those who live in high ivory tower....

those people living in the high ivory tower seem to possess futuristic vision. below that tower, peasants are suffering. they are crying. they work multiple jobs to make ends meet. some even were out of jobs. some lose out to the cheaper FTs. some prefer not to work instead of being exploited and paid miserly for their talents.....people like me ;9(

there are cries of foul-play. however, the paps being high up in their ivory tower cannot hear them, cannot see them...even if they can feel their sufferings, they prefer to numb those senses so that it would be less guilty to their conscience.

just think. if our pm could come up with this type of logic: INCREASE GST TO "HELP THE POOR", what other "pap's style of human reasoning" they couldn't come up with to smoke the peasants?

so in the end, are the poor and needies being helped? or have paps helped themselves further to the billions in extra revenues collected from taxes?

a country that is slowly being gnawed away by GREED will start to rot from the core outwards. it's like orchestraing for a fatal heart attack that will maim the entire nation.

when a heart attack is triggered, if lucky, the victim dies. if unlucky, he would be maimed or partially paralysed for life.

what the paps are doing now is walking along this route and putting the entire nation in a risk of getting that 'heart attack'.

i just pray that they could change their mindset and think more for the people than more concerned about how to grow their reserve coffer which they do not seem to be interested to use it back to benefit the peasants.

what reasoning they come up with? SM: TOO MANY SUBSIDIES is bad for the nation.

again, another warped logic. anything that benefit the peasants are actually the last thing in their minds. then why are we building up the reserves for?

we could be a happier nation.....but the paps just stop short there.

hmmm..

I don't read TOC..but surprise that they did not report on the SDP event..

TOC was at the Toa Payoh event almost the whole day..4 members were there including Andrew Loh and Selene..

I even got Andrew to purchase a TBT tee.. :-) (thank you Andrew!)

They were monitoring the petition signing every now and then..the young camera boy's camera were rolling all the time..capturing supporters who came to support..(I was joking with some friends they were more ISD than ISD..)

They even interview each other for their camera...(自导自演)..

Now I really wonder..why they want to waste time and effort on a event they don't intent to report? Or is it cause this time no arrest being made, so it's not new worthy to TOC?

hmmm....

I think TOC must have its deep-seated reasons for reporting the way they do. :) despite committing so much time and energy into the event.

Well the ISD oso spent alot of time monitoring and monitoring but never take action leh :)

Me oso heard police convoy was on standby nearby and oso never take action leh :)

Now they are going to get the teh-gus to come after us i heard. Will they take action? :)

I thought TOC portray themselves as non-partisan and neutral..

so why should they be behaving like the establishment?

I don't read TOC, as I have sgpolitics..but still to me..additional voice for the opposition is still welcome..

but can't help feeling disappointed that even TOC is not being neutral as what they claimed..just when my impression of Andrew changed when he make his TBT purchase and a donation...

is my pal right not to work?

before the economic downturn, he was holding a high paying job in an american mnc. his pay was in the region of 5 figures per mth.

later, the company closed and transferred to cheaper location in china - where else. he was retrenched with substantial benefits that could last him for quite a while.

the gabramen brags that our economy is better, more jobs are available. he applied for the same kind of job he's expert in. instead the pay offered was pathetic. it was barely 20% of what he used to get and there were more responsiblity thrown in.

the point was he rejected the post because he felt humiliated that the interviewer told him that for the same kind of pay, there are a couple of FTs who are highly qualified in paper education can easily filled the post.

he rejected cos' if they valued FTs' paper qualifications more than his personal expertise and professional experiences, so be it.

do u think my pal is doing the right thing? he choose to be unemployed cos he got the finance to live without much burden as he has invested very wisely and soundly too using his retrenchment benefits.

his idea was to return to the job circle to contribute his expertise but wasn't offered a reasonable reward. hence, he choose to squat instead of working.

SCENARIO 2:

a gf of mine who's a married mother of growup teens decided to go back to her banking job after a pause of 10 yrs.

she was actually retrenched as she used to be a branch manager of OUB which was fused into UOB (actually which is which is always that confusing to me).

anyway, she was abruptly retrenched. after being a housewife to look after her kids, she decided to work again just to keep her busy and occupied since her kids are bigger now.

the pay offerred was really pathetic and an insult to qualifications and her capability. anyway, she took the job cos her intention wasn't about the pay.

she just wanna spend time back to the banking job. she took it.

this is the second type of professionals who take up job for passing time only, not so much for the livelihood.

SCENARIO 3.

We are all in LEETAHSAR'S WHINNERS CLUB.

one best whinner who was the top of our class finally got a job offered after many years of squatting. again, the tragedy from the economic downturn.

his job pays very well. with all the perks and fringes thrown in, it was slightly above 10K per mth. there was a tiny little catch. he gotta to leave his family and go over to suzhou industrial park to work.

having being unemployed for many years and at the same time unfortunately bogged down to pay for his condo, he took up the job.

he's now permanently stationed in SIP - alone....and the whinning continues. we are MSN quite daily cos he is very lonely and misses his family and his children.

he's only entitled to return to singapore twice a year.

for the sake of his burden - the children education, the non working wife, the car, the condo' instalment, his aged parents etc - he tolerated all.

the last time i saw him, he looks like my grandfather - aged so much and all his hair had whitened. the truth is i was a couple of year older than him ....and he is now a very sad, stressed and lonely man working abroad.

as a bonus to his job, he is now inflicted with hypertension and psorarsis and has to be permanently on medication.

did he do the right thing to have taken this job?

According to the Government, the recent GST Credits were given “to help Singaporeans cope with the 2% GST increase from 1st July 2007″. I was given $200 GST Credits this year, which I believe is what most Singaporeans are getting.

However, I am a mother of two, and my children are not entitled to GST credits. Why have our young been forgotten? Our dependents should also be entitled to GST rebates for milk powder, diapers, health care costs, childcare services, school fees, textbooks, etc.

If the Government wants to encourage its citizens to procreate, why are our young children exluded from the GST rebates, leaving parents bearing the brunt of the GST increase?

How can the Government claim to have introduced a comprehensive GST Offset Package in Budget 2007 when our young have been forgotten?
